Carrying Concealed Weapon, commonly known as the CCW law, makes it illegal to conceal a dangerous weapon on your person or vehicle. Most convictions for carrying concealed weapon result from the unlawful carrying of a knife or handgun. But, the concealed weapon does not have to be a gun or knife.
Dangerous Weapon Defined
In a carrying concealed case in Michigan, the Prosecutor must prove you were carrying a dangerous weapon. A dangerous weapon means any object which is likely to cause serious bodily injury if it were used to commit an assault. Brass knuckles, shanks, or other devices that can be used to cause serious bodily injury can meet the definition of a dangerous weapon. Even a benign object can be considered a “dangerous weapon” if it is modified in a way to cause serious bodily injury during an assault. Since this is a serious felony, the Prosecution must prove you had knowledge of the weapon on your person or in the vehicle.
Maximum Sentence
If convicted of carrying a concealed weapon in Michigan, you could face up to five years in prison. Your weapon will be forfeited and you will face the consequences of a convicted felon. If you have a prior felony conviction, then your sentence can be enhanced by the Michigan Habitual Offender law.
